General terms

General terms for engagements with DonIT&Security — B2B, prices excl. VAT, you own the deliverables.

Last updated: 5 November 2026

Draft. Final wording to be confirmed by the owner before relying on it contractually.

1. Scope

These terms apply to every quote, engagement and deliverable of DonIT&Security (Pieter Donche, Eppegem, Belgium, BTW BE1021284326), hereafter “DonIT”. DonIT works for businesses and organisations only (B2B). Deviations are valid only when agreed in writing.

2. Quotes and prices

All prices are in euro and exclude VAT. Prices on the website are starting prices. Every engagement starts with a free scoping call and a written quote with explicit scope and explicit exclusions. Work outside that scope is quoted separately before it starts. Quotes are valid for 30 days.

3. Delivery and availability

DonIT is a one-engineer company. Work is delivered in planned engagements with a limited number of slots per quarter, not as a helpdesk. No 24/7 availability, response-time guarantee or SLA is offered unless explicitly agreed in writing.

4. Payment

Invoices are payable within 30 days. For projects, a 40% deposit is invoiced at the start and the balance at delivery, unless the quote says otherwise. Retainers and managed hosting are invoiced monthly in advance. Late payment incurs the statutory interest and a fixed €40 recovery cost under Belgian law.

5. Intellectual property

Upon full payment, the client owns the code, repository, documentation and data delivered for the engagement, except for pre-existing DonIT tooling and open-source components, which are licensed under their respective licences. DonIT may reuse general know-how and non-client-specific components.

6. Security testing

Penetration tests and assessments are performed only against systems the client owns or is authorised to have tested, within written rules of engagement. The client is responsible for backups before testing starts. Findings are reported confidentially and are not shared with third parties.

7. Confidentiality

Both parties keep confidential information confidential, during and after the engagement.

8. Liability

DonIT’s liability is limited to the amount invoiced for the engagement concerned. DonIT is not liable for indirect damage, loss of data or loss of revenue. Nothing excludes liability that cannot be excluded under Belgian law.

9. Applicable law

Belgian law applies. Disputes are brought before the courts of the judicial district of Brussels.
